Launch a Project
1. Payment Terms
Payment is due upon receipt unless otherwise negotiated via email.
All production orders require a 50% deposit before work can begin, with the remaining balance due upon project completion. Delays in payment may result in production holds or refusal of service.
2. Timeline & Project Confirmation
Submitting this form does not guarantee a production slot or turnaround timeline. All jobs must be confirmed by NYES via email, and production schedules will be based on current capacity and project requirements.
3. Sampling & Revisions
Sampling fees are non-refundable. Revisions outside the approved scope of work may incur additional charges and extend the production timeline. If material or design changes are made after sampling, a new sample may be required.
At NYES’s discretion, a portion of the sampling invoice may be credited toward a bulk production order, depending on the volume and scope of the order.
4. Ownership & Usage Rights
By submitting artwork, the client confirms they have the legal right to use all logos, images, and intellectual property included.
NYES may photograph completed work for internal documentation and portfolio purposes. Public sharing (e.g., on social media or other marketing platforms) will only occur if the client has granted permission via the checkbox on the submission form.
5. Cancellations
All cancellations must be submitted via email. If a project is canceled after production has begun, the client is responsible for all costs incurred to date, including labor, materials, sampling, and administrative work. Deposits are non-refundable once production begins.
6. Final Approval & Disputes
Once a job is approved or a sample is signed off, further changes may incur additional fees. If there is a dispute regarding final output, NYES reserves the right to evaluate the situation on a case-by-case basis, but we are not obligated to offer replacements or refunds for approved work or client-side miscommunication.
7. Client Responsibility
It is the client’s responsibility to provide all necessary materials, artwork, specifications, and placement instructions prior to production. NYES is not responsible for dissatisfaction or rework resulting from incomplete, vague, or contradictory information.
8. Creative Discretion
NYES reserves the right to exercise creative discretion when clients do not provide clear, complete, or true-to-scale artwork, mockups, or instructions. While we will always do our best to align with your vision, decisions made in the absence of sufficient direction are considered final and not subject to dispute.
9. Testing, Materials & Spoilage
While every effort is made to handle client-supplied goods with care, NYES cannot guarantee against potential issues resulting from material inconsistencies or production variables beyond our control. A spoilage allowance of up to 5% is considered standard in custom production. Clients are strongly encouraged to provide sufficient extras for testing, sampling, and potential loss. Any goods submitted without prior email notice will be treated as replaceable.
